Agreement to terms

By accessing or using FairMediate (“the Service”), you agree to be bound by these Terms of Service. The Service is operated by Known By One LLC, 131 Continental Dr, Suite 305, Newark, DE 19713.

If you do not agree to these terms, do not use the Service.

Description of service

FairMediate is an AI-powered tool that facilitates structured discussions between two parties who have a disagreement. The Service provides:

  • Private AI advocate conversations for each party
  • A neutral AI mediator that synthesizes both perspectives
  • Iterative proposals that both parties can review and respond to

What the Service is NOT

FairMediate is not a licensed mediation service. It is important that you understand the following:

  • The Service does not provide legal advice. Consult a qualified attorney for legal matters.
  • The Service does not provide therapy or mental health counseling. Seek a licensed professional for mental health concerns.
  • The Service does not provide professional mediation. For formal mediation, contact a certified mediator.
  • Agreements reached through the Service are not legally binding unless separately formalized through appropriate legal channels.

Appropriate use

The Service is intended for interpersonal disagreements where:

  • Both parties voluntarily choose to participate
  • The dispute is non-violent and non-abusive
  • Neither party requires legal representation
  • Both parties are at least 18 years of age

Do not use this Service in situations involving domestic violence, abuse, harassment, threats, custody disputes, active litigation, or any situation where one party's safety is at risk. If you are in danger, contact local emergency services or the National Domestic Violence Hotline at 1-800-799-7233.

User conduct

When using the Service, you agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to manipulate, deceive, or exploit the AI systems
  • Share another person's private information without their consent
  • Use the Service to harass, threaten, or intimidate another person
  • Attempt to access another party's private advocate conversation

Privacy and data

Your use of the Service is also governed by our Privacy Policy. Key points:

  • Session creators sign in with a free account; invited participants join via link with no account
  • All session data is automatically deleted after 30 days
  • Conversations are encrypted in transit
  • We do not sell, share, or use your data for advertising or AI model training

Intellectual property

The Service, including its design, code, content, and research, is the property of Known By One LLC. You may not copy, reproduce, or redistribute the Service or its components without written permission.

Content you create through the Service (your messages, agreements) belongs to you and the other participating party.

Limitation of liability

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied.

Known By One LLC is not liable for any outcomes, decisions, or actions taken based on the use of this Service. This includes, but is not limited to:

  • The quality, accuracy, or fairness of AI-generated proposals
  • Failure to reach an agreement
  • Any consequences of agreements reached through the Service
  • Loss of data or service interruptions

To the maximum extent permitted by law, Known By One LLC's total liability for any claim arising from or relating to the Service shall not exceed $100 USD.

Indemnification

You agree to indemnify and hold harmless Known By One LLC, its officers, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
